These Terms and Conditions ("Terms") govern your use of the Ferth Healthcare Management platform ("Service") operated by Ferth ("us", "we", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you disagree with any part of these terms, then you may not access the Service. These Terms apply to all visitors, users, and others who access or use the Service.

Service Description

Ferth provides a comprehensive healthcare management platform designed for medical professionals, including but not limited to:

  • Patient management and electronic health records
  • Appointment scheduling and calendar management
  • AI-powered medical documentation assistance
  • Billing and payment processing through Razorpay
  • Prescription management and medicine inventory
  • Clinical decision support tools
  • Reporting and analytics features

User Accounts and Registration

Account Requirements

  • You must be a licensed healthcare professional to create an account
  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You must notify us immediately of any unauthorized use of your account

Account Responsibilities

  • You are solely responsible for all activities under your account
  • You must comply with all applicable healthcare regulations (HIPAA, etc.)
  • You must not share your account with unauthorized individuals
  • You must keep your professional license and credentials current

Payment Terms and Razorpay Integration

Subscription and Billing

  • Subscription fees are billed in advance on a monthly or annual basis
  • All payments are processed securely through Razorpay payment gateway
  • Prices are subject to change with 30 days advance notice
  • Failed payments may result in service suspension
  • You authorize us to charge your payment method for recurring subscriptions

Razorpay Payment Processing

  • All payment transactions are processed by Razorpay, our authorized payment partner
  • Razorpay's terms and conditions apply to all payment transactions
  • We do not store your complete payment card information on our servers
  • Payment disputes should be reported within 60 days of the transaction
  • Refunds, if applicable, will be processed through the same payment method

Payment Security

  • All payment data is encrypted and transmitted securely
  • We comply with PCI DSS standards for payment security
  • Suspicious payment activities may result in account suspension
  • You are responsible for any charges incurred on your account

Acceptable Use Policy

You MAY:

  • Use the Service for legitimate healthcare purposes
  • Store and manage patient data in compliance with regulations
  • Access the Service from authorized devices
  • Integrate with approved third-party applications

You MAY NOT:

  • Use the Service for illegal or unauthorized purposes
  • Attempt to breach security or access unauthorized data
  • Share your account credentials with unauthorized users
  • Reverse engineer or attempt to extract source code
  • Use the Service to spam or send unsolicited communications

Data Protection and Privacy

Data Ownership and Control

  • You retain ownership of all patient data entered into the system
  • We act as a data processor under applicable privacy laws
  • You can export your data at any time in standard formats
  • Data deletion requests will be honored in accordance with legal requirements

Service Availability and Support

Service Level

  • We strive for 99.9% uptime availability
  • Scheduled maintenance will be announced in advance
  • Emergency maintenance may occur without notice
  • Service interruptions will be communicated promptly

Customer Support

  • Email support available during business hours
  • Priority support for premium subscribers
  • Knowledge base and documentation available 24/7
  • Training and onboarding assistance provided

Limitation of Liability

IMPORTANT: The Service is provided "as is" without warranties of any kind. To the maximum extent permitted by law, Ferth shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business interruption.

Our total liability for any claims arising from or related to the Service shall not exceed the amount paid by you for the Service in the 12 months preceding the claim.

Termination

By You

  • You may terminate your account at any time
  • Cancellation takes effect at the end of the billing period
  • You remain responsible for charges incurred before termination

By Us

  • We may terminate for violation of these Terms
  • We may suspend service for non-payment
  • 30 days notice will be provided when possible

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the new Terms.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts in [Your City], India.
